Final Rule Prohibiting Reimbursement of Contractors for Costs Related to Influencing Unionization Decisions

On November 2, 2011, the Department of Defense (“DoD”), General Services Administration (“GSA”), and National Aeronautics and Space Administration (“NASA”) issued a final rule implementing President Obama’s Executive Order 13494, Economy in Government Contracting (“EO 13494”).  EO 13494 prohibits government contractors from being reimbursed for activities aimed at influencing employees’ decisions to unionize or bargain collectively.

NLRB Issues Final Rule Requiring Employers to Post a Notice on Employee Rights Under the NLRA

On August 25, 2011, the National Labor Relations Board (“NLRB”) issued a final rule requiring all employers covered by the National Labor Relations Act (“NLRA”) to post a notice informing employees’ of their rights under the NLRA. The notice must be posted in a conspicuous place where the employer customarily posts such notices to employees, which could include the Internet or intranet sites. Employers who have failed to post the notice in compliance with the final rule can be found to have committed an unfair labor practice. The final rule goes into effect on November 14, 2011.
